Terms and Conditions

Maxmedia.co.uk is here referred to as the trade name of Richard G. Howard, Sole Proprietor and Manager.

1. Nature of Agreement and Cancellations

The Maxmedia.co.uk website is an attempt to induce offers to purchase the products or services of Maxmedia.co.uk. BY PLACING AN ORDER OR MAKING A PAYMENT TO MAXMEDIA.CO.UK, YOU ARE MAKING AN OFFER TO PURCHASE. While Maxmedia.co.uk may make reasonable efforts to accept offers to purchase, Maxmedia.co.uk reserves the right to refuse any order, in which case any relevant payment will be refunded. Should Maxmedia.co.uk accept your offer to purchase, then you are bound by these Terms and Conditions. Once your order has been accepted it can only be cancelled if both parties agree, or if fulfilment becomes unreasonably difficult due to circumstances beyond the control of Maxmedia.co.uk. If not communicated otherwise, then acceptance will be indicated by fulfilment of the order. These Terms and Conditions are subject to occasional change without notice.

2. Delivery
Short or surplus deliveries of up to 10% variance are to be accepted, and in the case of litho print, may include a small ammount of spoilage. If you do not receive ordered products in a timely manner and in good condition then Maxmedia.co.uk will expect you to make contact so that the situation can be best remedied.

3. Product Returns and Refunds

If you believe the product or service of Maxmedia.co.uk is not of merchantable quality then you are entitled to return any products within 14 days of receipt. Assuming we agree with your complaint then you are entitled to a full refund of the price paid for the products returned. The return of printed products, or complaint about printed products shall only relate to print quality, paper quality, or timeliness, and shall not relate to the design of any product which you yourself have specified, including but not limited to, text size, legibility, colour choice etc.

4. Limitation of Liability

Nothing in this Agreement will affect your statutory rights as a consumer. If Maxmedia.co.uk, its associates, sub-contractors, service providers, or other business partners are found to be directly or indirectly liable for damage or loss of any kind in the fulfilment of this Agreement, then such liability shall be limited to the price paid for products or services. This clause survives termination of the Agreement for any reason.

5. Indemnity

You agree to fully indemnify Maxmedia.co.uk, its associates, sub-contractors, service providers, and other business partners from all claims, proceedings, losses, costs, damages, actions and demands (including but not limited to professional advisers fees) relating to the printing of products in accordance with your designs or instructions, and from any intellectual property right or other right infringed by the printing of products in accordance with your designs or instructions.

6. Entire Agreement

This Agreement constitutes the entire Agreement and any communications outside of this Agreement will not be legally binding.

7. Severability

If any part of this Agreement proves unenforceable then all other parts shall remain in full force and effect.

8. Governing Law

This Agreement shall be bound by English Law, and subject to the jurisdiction of the English Courts.
